Liability Agreement & Waiver

This Liability Agreement (“Agreement”) is entered into by and between Olivia Marie Leschnik, doing business as Begin Again and Inspired Wellness (hereinafter referred to as “Provider”), and the undersigned individual (“Participant”), or their legal guardian if under the age of 18.

This Agreement shall be governed by and construed in accordance with the laws of the State of California

1. GENERAL LIABILITY WAIVER

Release of Liability and Assumption of Risk Participant understands and acknowledges that participation in fitness classes, health coaching, or training and massage involves physical activity that may result in injury. Participant voluntarily assumes all risks associated with participation and agrees to release, waive, and hold harmless Olivia Marie Leschnik of Begin Again and Inspired Wellness, its instructors, employees, and agents from any and all claims, liabilities, damages, or demands arising from participation. Participant affirms they are physically fit and capable of participating in the activities provided.

This release includes claims for ordinary negligence, but does not include claims arising from gross negligence or willful misconduct.

2. PHOTO AND VIDEO RELEASE

Permission to Use Likeness Participant grants permission to Olivia Marie Leschnik of Begin Again and Inspired Wellness to photograph and record video during classes, massages, and events. These materials may be used without limitation for promotional, educational, or commercial purposes. Participant waives any rights to royalties or compensation for their use.

3. MEDICAL WAIVER

Emergency Medical Treatment Authorization In the event of an injury or medical emergency, Participant authorizes Olivia Marie Leschnik of Begin Again and Inspired Wellness to seek appropriate medical treatment. This authorization does not obligate the Provider to seek medical care but allows them to do so in their discretion. Participant understands that they are responsible for any medical expenses incurred. 

4. COVID-19 WAIVER

Assumption of Risk and Waiver of Liability Related to COVID-19 Participant acknowledges the contagious nature of COVID-19 and voluntarily assumes the risk of exposure or infection through participation in activities at Olivia Marie Leschnik of Begin Again and Inspired Wellness. Participant agrees to hold harmless the Studio, its staff, and affiliates from any claims arising from exposure or infection.

5. CANCELLATION AND RESCHEDULING POLICY

* Cancellations within 6 hours of the scheduled class are not permitted, and no refund will be issued.

* If Participant needs to reschedule, it must be done at least 6 hours before the class start time.

* Failure to reschedule within the appropriate timeframe will result in the forfeiture of payment for the missed class.

* To reschedule, Participant must call, text, or email Olivia Marie Leschnik of Begin Again and Inspired Wellness.

6. CODE OF CONDUCT

To maintain a positive and respectful environment, all participants must:

* Show respect towards instructors, therapists, staff, and fellow students.

* Wear appropriate attire and follow the class dress code.

* Arrive on time and be prepared for class or service.

* Avoid disruptive behavior that interferes with the learning experience.

*Offensive or inappropriate language or behavior is strictly prohibited.

Failure to adhere to these guidelines may result in dismissal from participation in programs or services without refund.

7. INJURY REPORTING POLICY

Any injuries sustained during class must be reported to the instructor or Provider staff immediately to ensure proper care and documentation.

8. PERSONAL BELONGINGS DISCLAIMER

Olivia Marie Leschnik of Begin Again and Inspired Wellness is not responsible for any lost, stolen, or damaged personal belongings. Participants are encouraged to keep valuables at home or secure them in designated areas.

9. PAYMENT POLICY

* All class payments are non-refundable except as stated in the cancellation and rescheduling policy.

* Any outstanding balances must be paid before participation in future classes.

* Late payments may be subject to additional fees.

10. DRESS CODE POLICY

To ensure safety and comfort, all participants must adhere to the following dress code: Participants must wear clean, appropriate attire suitable for movement. No loose jewelry or accessories are allowed.

11. LIABILITY FOR PROPERTY DAMAGE

Participants (or parents/guardians) are responsible for any damage they cause to Provider property due to negligence or failure to follow instructions. A fee may be charged for repairs or replacements.

12. EMERGENCY CONTACT INFORMATION

Participant must provide an emergency contact name and phone number before participating in any class.

13. INCLEMENT WEATHER & STUDIO CLOSURE POLICY

In the event of class cancellations due to inclement weather or Studio-related closures:

* Participants will be notified via email, text, or phone call.

* Refunds or rescheduling options may be provided at the Provider’s discretion.

The Provider will make reasonable efforts to notify Participants at least 1 hour before the scheduled class time.

14. CONSENT FOR PHYSICAL CONTACT

Participants acknowledge that instruction may require physical corrections by instructors for guidance and safety. If a participant does not consent to this, they must notify the instructor before class.

Physical contact is required for massage therapy services.

15. GUEST & SPECTATOR POLICY

* Only registered students may enter the dance floor during class.

* Guests or spectators are allowed only in designated areas.

* Unauthorized guests may be asked to leave.

16. DISPUTE RESOLUTION CLAUSE

Any disputes arising under or relating to this Agreement shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA) or similar body.

17. LATE ARRIVAL POLICY

Participants arriving more than 30 minutes late may not be allowed to join the class for safety reasons.

Participants arriving late to a private service will forfeit any time lost and the appointment will end at the scheduled time unless Provider can make the accommodation.

Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

If the Participant is under the age of 18, the undersigned parent or legal guardian acknowledges and agrees to the terms of this Agreement and consents to the Participant’s participation.
